- Order HAC/265/2024 approves the 2023 income and wealth tax forms and sets the filing period: 3 April to 1 July 2024.
- If an amount is payable and payment is direct-debited, the return must be filed by 26 June, unless only the second instalment is direct-debited.
- It pays to gather tax data and supporting documents, review the draft and bear in mind that since 2023 all self-employed people must file a return.
The Official State Gazette of 22 March 2024 publishes Order HAC/265/2024 of 18 March, which approves the personal income tax and wealth tax returns for the 2023 financial year and sets the place, form and deadlines for filing. The income tax return can be filed from 3 April to 1 July 2024 inclusive, and the wealth tax return in the same period. From 3 April taxpayers can obtain the draft and tax data electronically.
There are two deadlines to tell apart. If the result is payable and payment is direct-debited, the return must be filed by 26 June; if only the second instalment of income tax is direct-debited, it can be done until 1 July. The Tax Agency had already made the tax data and the campaign’s information materials available on 19 March.
Who must file
The obligation depends on income and its source. For earned income in cases of more than one payer, among other situations, the order recalls that the lower threshold for the obligation to file is 15,000 euros a year, set by the 2023 Budget Act. From the 2023 financial year, all people who were registered as self-employed at any time during the year must also file, as must holders of the minimum living income. Those not obliged who wish to claim a refund must also file.
The order also regulates the repayment of the aid under article 31 of Royal Decree-law 11/2022, which is done through an electronic form available from 3 April to 1 July with no late-payment interest until that date. Anyone who must repay that aid can do so this way, independently of their tax return.
How to file
Filing is electronic, through the draft and return processing service on the Tax Agency’s website. Tax data should be checked before confirming the draft, because failing to obtain it does not release you from the obligation to file on time. Those who opt to direct-debit payment can split it into two instalments. The Tax Agency also offers telephone and in-office assistance, later in the campaign, for anyone who needs help with the draft.
The wealth tax deadline coincides with that of income tax, and the form keeps the structure of the previous year. People with substantial assets should review valuations and bear in mind that the temporary solidarity tax on large fortunes is filed with its own form, number 718.
What to prepare
Before the campaign starts, it is useful to gather the documentation that does not usually appear in the tax data: deductible rental expenses, pension plan contributions, donations, loan interest receipts, supporting documents for aid and information on investments and crypto-assets, if applicable. Check that the details of children and spouse are correct, because they determine allowances and deductions.
Anyone who has sold a home, received an inheritance or a gift, or transferred shares or funds should review the treatment of each transaction. When in doubt about regional deductions or complex transactions, the prudent course is to consult your adviser before confirming the draft.
A tax campaign is won with the data reviewed before opening the draft.
